1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Muhammad Ahmed Sheikh, trading as Ahvem ("we," "us," or "our") governing your access to and use of our software-as-a-service products, tools, APIs, and related services (collectively, the "Service").
By creating an account, subscribing to a plan, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. The Service
We provide AI application development and engineering services, software products, and subscriptions — including full-stack AI applications, agentic AI systems, and ongoing monthly retainer engagements. Specific deliverables, features, and availability vary by package and are described at the point of purchase.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide advance notice of material changes where practicable.
3. Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You must be at least 18 years old and have the legal capacity to enter into contracts to register. Accounts may not be shared between individuals or transferred without our prior written consent.
4. Subscriptions and Payment
The Service is offered as one-time fixed-price builds and ongoing monthly retainer plans, as described on our Pricing page. All prices are in USD and exclude applicable taxes.
Merchant of Record. All payments are processed by Paddle.com Market Limited("Paddle"), who acts as our Merchant of Record for all transactions. By purchasing, you also agree to Paddle's Buyer Terms and Privacy Notice. Tax invoices are issued by Paddle on our behalf.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. We will notify you of any price changes at least 30 days in advance.
5. Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — your access continues until that date and you will not be charged again.
We may terminate or suspend your account if you violate these Terms, with or without notice depending on the severity of the violation.
6. Refunds
Refund eligibility is governed by our Refund Policy. We offer a 30-day money-back guarantee on first-time purchases. Because Paddle is our Merchant of Record, refund requests are processed through Paddle and are subject to their refund procedures.
7. Acceptable Use
You agree not to:
- —Use the Service to violate any applicable law or regulation.
- —Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- —Resell, sublicense, or otherwise exploit the Service for commercial purposes not permitted under your plan.
- —Use the Service to transmit malware, spam, or other harmful content.
- —Attempt to gain unauthorised access to any system, network, or account.
- —Use the Service to generate, distribute, or facilitate illegal, abusive, or fraudulent content.
- —Circumvent usage limits or technical restrictions.
We reserve the right to suspend or terminate access for any violation without refund.
8. Intellectual Property
The Service and all content, technology, and software underlying it are owned by Muhammad Ahmed Sheikh or our licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights.
You retain ownership of any data or content you submit to the Service ("Customer Data"). By submitting Customer Data, you grant us a limited licence to use it solely to provide and improve the Service.
9. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUHAMMAD AHMED SHEIKH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
12. Indemnification
You agree to indemnify and hold harmless Muhammad Ahmed Sheikh and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Disputes
These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts of Pakistan.
Before initiating any legal action, you agree to first contact us at ahmed369ww@gmail.com and attempt to resolve the dispute informally for at least 30 days.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 14 days before changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
